At Grouped, Inc., we are committed to protecting your privacy. This privacy policy explains how we collect, use, and share your personal information when you use our software and services.

Personal  Information We Collect

If you are an artist or creator (“Artists”) we collect information you provide when you  (i) create an account; (ii) create a community on Grouped (a “Group”) and (iii) manage and interact with your Groups. The personal information we collect from Artists includes:

  1. Basic contact information – name, email address, phone number, and shipping address.


  1. Government ID – state ID, passport, etc. This information is collected  because it is legally required to distribute payment to Artists. This information is collected and processed solely by our third-party payment processors and is not viewed, collected, or stored by Grouped.


  1. Public content you submit – posts, videos, and livestreams you post using our services.


  1. Private content you submit – direct messages sent to Fans and messages sent to Grouped (for customer services purposes). 

  1. Anonymous or aggregated information – information regarding how Artists use the services, which is collected and used in a way that does not identify any individual Artist.

  1. Information collected automatically – please see Automated Collection Technologies for more information.


If you are a fan who signs up to use our service to support an Artist (“Fans”) we collect the information you provide when you create an account and when you interact with Artists and Groups. The information we collect from Fans includes: 

  1. Basic contact information – name, email address, phone number, and shipping address.

  2. Public content you submit – content you post on the services (in connection with a Group). You may request that we delete content you post on the services and we will do what we can to comply with such requests; however, we cannot guarantee complete or comprehensive removal of such content from the Internet (including, via services that archive historical versions of webpages); additionally, if you would like for an Artist to delete content you have submitted to them (e.g., if you provide video from a performance for the Artist’s use) please reach out to the Artist directly.

  3. Private content you submit – direct messages sent to Artists and messages sent to Grouped (for customer service purposes).

  4. Payment information – payment card information necessary to make a purchase. This information is collected and processed solely by our third-party payment processor and is subject to their terms and conditions and privacy policies. This information is not viewed, collected, or stored by Grouped (other than a hashed credit card number typically seen on receipts to associate a transaction with a particular payment method).

  5. Transaction information – information about the product or service purchased (purchase dates, amounts paid, and whether the order was fulfilled).

  6. Anonymous or aggregated information – information regarding how Fans interact with the services, which is collected and used in a way that does not identify any individual Fan.

  7. Information collected automatically – please see Automated Collection Technologies for more information.

Information Collected from Other Sources. We may receive information about you from other sources. For example, Artists may upload contact information about their fans that they have collected outside of our platform to send marketing communications to the fans.

Automated Collection Technologies. Information such as Internet protocol addresses, page requests, browser type, operation system, and average time spent on sites may be collected using automated data collection technologies and monitored for quality improvement.

  1. Grouped uses session, persistent, and third-party cookies, which are tiny data elements that Grouped websites can send to individual browsers to be stored on hard drives and recognize users upon return. Users may set their Web browsers to provide notification when cookies are received. Users can opt to not accept cookies, which may limit certain functionality on Grouped’ sites. 

  2. Cookies. Cookies may be used to identify customers, access account information to deliver products and personalized services, understand browsing habits and purchase activities, and personalize sites according to user preferences. Cookies are also required to optimize shopping experiences.

  3. Web Beacons. Grouped uses web beacons, either directly or from partners, along with cookies, to determine if a user has visited a particular website. These beacons aid in providing more relevant advertising to the user, as well as measuring the success of an advertising campaign.

  4. Session/Persistent Cookies. A session cookie is a cookie that stores information as a user is using a site but is deleted once the browser session is finished.  A persistent cookie is a cookie that stores information as a user utilizes a site and stores and uses that information in connection with future visits of the user to the site.  

  5. Third Party Cookies/Web Beacons. Third party cookies and/or web beacons are cookies or web beacons provided by technology and/or advertising partners.  Any third-party cookie or web beacon authorized for use on the site collects that information described herein for the same stated purposes as if we were directly collecting the information. For a third-party cookie or web beacon, the third party will have access to the collected information in order to provide us with information or services to enhance the performance and functionality of the site.

The cookies and web beacons used on the sites collect information about users of the site, including: IP address, device IDs, browser used to access the site, date and time, the URL of the page being loaded, users who have visited a particular website(s), any previously assigned cookie identification (a unique identifier assigned to a user to identify repeat visitors), browser window size, the geographic location of the user, device and operating system used to access the site. Some of this information may constitute personal information. The information collected from these cookies and web beacons is used to determine information about a user’s visit to the sites, including the number of visits, average time spent, pages viewed, navigation history through the website, and other statistics. This information is used to enhance the users experience while visiting the sites and to improve the performance of the sites by, among other things, allowing us to monitor site performance, making the sites easier to use, measuring the effectiveness of promotional placements, and tailoring the sites (including the ads and offers a user receives) to better match a user’s interests and preferences. 

Users who prefer not to accept cookies can set their Internet browser to notify them when they receive a cookie or to prevent cookies from being placed on their hard drive.

If you consent to our collection of cookies and you subsequently wish to withdraw your consent, you can manage the settings on your web browser to delete all cookies and disallow further acceptance of cookies. Please note that disabling cookies on your browser will prevent tracking of your activities in relations to the sites, however, it may also disable some of the functions and features of the sites and the sites may not work properly.

How We Use Your Personal Information

We use the personal information we collect to provide, maintain, and improve our services, to communicate with you, and to personalize your experience. We also use your personal information to provide the services you request, to verify Fan or Artist information, and to process and fulfill orders and transactions. 

We also use your  personal information to prevent fraud and abuse, and to comply with legal obligations.

We may also use aggregated or de-identified personal information that does not identify you for any business purpose.

How We Share Your Personal Information

Artist Marketing

If you are a Fan, please note that by connecting to an Artist, you consent to us providing your name, email address, and phone number to that Artist. The Artist may choose to market to you using the email address and phone number provided. If you do not wish to receive communications from the Artist, please contact the Artist directly. 

We encourage you to review the Artist’s privacy policy for details regarding how they handle your personal information and how you may opt out of receiving communications from the Artist. 

Service Providers

We may share your personal information with third-party service providers who perform services on our behalf, such as web hosting, payment processing and email marketing. 

Legal Matters

We may also share your personal information with law enforcement or government officials when we are legally required to do so. We may also disclose personal information to assist in debt collection or to exercise our rights or legal obligations where the data is pertinent.

Affiliated Entities

Grouped and its affiliates may share personal information or provide each other and their service provider with access to information for the purposes described in this Privacy Policy.

Mergers or Acquisitions

If Grouped, or some of its assets, is sold, transferred or used as security (or are proposed to be sold, transferred, or used as security), personal information may be transferred or disclosed to third parties as part of that transaction.

With Your Consent

Grouped will disclose your personal information with your consent or otherwise at your direction, such as when you post in public forums in our services.

Anonymized, Aggregated or De-identified Information

We may share information about you that has been aggregated or anonymized such that it cannot reasonably be used to identify you.

Your Choices

You can choose to limit the personal information you provide to us or post on our services. If you would like to opt out of receiving marketing related email communications from Grouped, you may opt out in your account settings or by clicking “Unsubscribe” in the marketing email and following the instructions.

Data Retention

We retain your personal information as long as necessary to provide our services, or as required by law. We may also retain your personal information after you delete your account if required for legal, regulatory, or technical reasons.

Data Security

We implement security measures to protect your personal information from unauthorized access, disclosure, alteration, or destruction. However, like any website we cannot guarantee that your personal information will be 100% secure. We encourage you to take steps in your control to protect your personal information such as protecting your passwords. Please contact us immediately if you believe your account has been compromised.

Children’s Privacy

Our services are not intended for use by children, which we consider to be under the age of 13, and we do not knowingly collect or maintain personal information from children under 13. If we become aware that we have collected personal  information from a child under 13, we will take steps to delete the personal information as soon as possible.

Your Privacy Rights

Grouped may make certain requests with respect to their personal information, and Grouped will take reasonable steps to comply with such requests subject to certain limitations and exceptions under applicable law: 

Right to Know: to request to know more details about the categories and specific pieces of personal information we collect, use, disclose, sell or share about you.

Right to Delete: to request deletion of your personal information.

Right to Access: to request that we provide a copy of the personal information we have collected about you, in a portable and, to the extent technically feasible, readily usable format.

Right to Correct: to request that we correct personal information we have about you that is incorrect.

Right to Opt-out: to request to opt-out of the sale of your personal information for valuable consideration or sharing of your personal information for purposes of cross-context behavioral advertising, targeted advertising, or profiling in furtherance of decisions that produce legal or similarly significant effects.

You may make a request to exercise such right(s) by by contacting us at privacy@grouped.com. We will not discriminate against you for exercising these rights.

Once we receive your request, we may ask you to verify your contact information and may ask you for information related to your recent interactions with us, such as information about a recent purchase, to verify that it is you making the request. 

You may also appoint an authorized agent to exercise these rights on your behalf. If you use an authorized agent, we may ask you to verify your identity with us directly or confirm with us that the agent otherwise has your permission to submit the request on your behalf. 

If you make a request to exercise any of the above data access rights and we are unable to comply with your request, you may request to appeal our decision by following the instructions provided in our response. 

Changes to this Policy

We may update this privacy policy from time to time. If we make any material changes, we will notify you by email using the email address associated with your account, by posting a notice on our services, or using another method if required by applicable law.

This General Data Protection Regulation (“GDPR”) notice applies to persons in the European Economic Area (“EEA”), including those based in the United Kingdom (“UK”). This GDPR notice supplements our privacy policy, however, where our privacy policy conflicts with this GDPR notice, the GDPR notice will prevail as to persons located in the EEA and the UK.

  • Access: You have the right to ask us for copies of your personal information subject to applicable exemptions, which means you may not always receive all the personal information we process. 

  • Rectification:  You have the right to ask us to rectify personal information you think is inaccurate. You also have the right to ask us to complete personal information you think is incomplete. Note, however, that we may need to verify the accuracy of the new information you provide to us.

  • Erasure/deletion: You have the right to ask us to delete or erase your personal information in certain circumstances. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons, which will be notified to you, if applicable, at the time of your request.

  • Restriction of processing:  You have the right to ask us to restrict the processing of your personal information under the following circumstances: (a) if you want us to establish the information’s accuracy; (b) where our use of the information is unlawful but you do not want us to erase it; (c) where you need us to hold the information even if we no longer require it as you need it to establish, exercise, or defend legal claims; or (d) you have objected to our use of your information but we need to verify whether we have overriding legitimate grounds to use it.

  • Right to object to processing: You have the right to object to processing if we are processing your personal information where the processing is in our (or those of a third party’s) legitimate interests. You are not required to pay any charge for exercising your rights. These rights will be exercisable subject to limitations as provided for by the GDPR/UK GDPR.

You can also withdraw your consent at any time where we are relying on your consent to process your personal information. Please note that your withdrawal will not affect the lawfulness of any processing carried out before you withdrew your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

Where we transfer your personal information outside the EEA and the UK to our service providers, we transfer it subject to the appropriate safeguards as permitted under the GDPR/UK GDPR, such as the applicable EU Standard Contractual Clauses or their UK equivalent, to facilitate international transfers of personal information collected in the EEA and the UK.
